Guest Rental Agreement and Policies

Short-Term Vacation Rental — Ontario, Canada Governed by the laws of the Province of Ontario and applicable federal laws of Canada

This Rental Agreement and Policies ("Policies") form part of your binding Short-Term Vacation Rental Agreement with Maplewood Getaways. By completing a booking or accessing the Property, you confirm that you have read, understood, and agreed to all terms below. These Policies apply to all guests, occupants, and visitors at the Property during your stay. This licence to occupy does not create a tenancy under the Residential Tenancies Act, 2006 (Ontario).

1Payment Terms
1.1
Payment Schedule. Your total rental amount is collected in two instalments:
  • Deposit (50%): Due immediately upon booking confirmation to secure your reservation.
  • Balance (50%): Due no later than 14 days before your scheduled arrival date. If the balance is not received by this date, Maplewood Getaways reserves the right to cancel the reservation without notice and without refund of the initial deposit.
1.2
Payment Processing. All payments are processed through Stripe, a secure third-party payment processor. Maplewood Getaways does not collect, store, or have access to your credit card details. Payments may also be accepted via PayPal or Interac e-Transfer as offered at time of booking. By submitting payment, you agree to the applicable terms of the payment processor used.
1.3
Security Deposit — Pre-Authorization Hold. A security deposit equal to 10% of your total rental amount will be pre-authorized on your payment method approximately 24 hours before your arrival date. This is a hold only — no funds are captured unless a valid claim arises. The hold will be released within up to 7 business days following your check-out date, subject to a satisfactory property inspection. By confirming your booking, you authorize this pre-authorization.
What the Security Deposit CoversThe security deposit may be captured, in whole or in part, to cover: damage to the property, furnishings, fixtures, or appliances beyond normal wear and tear; excessive cleaning required beyond standard post-stay cleaning; loss of or damage to keys, access devices, or smart lock systems; noise violations, fines, or penalties attributable to the guest; unauthorized pets, guests, or events; any unpaid fees or outstanding amounts owing under this Agreement. This list is non-exhaustive. Where damage or losses exceed the deposit amount, the guest remains personally liable for the full outstanding balance.
1.4
Currency. All amounts are stated and payable in Canadian dollars (CAD) exclusively. Maplewood Getaways does not accept payment in any other currency.
1.5
Chargebacks & Non-Payment. If a guest initiates a chargeback, payment reversal, or dispute with their financial institution or payment processor for any amount validly charged under this Agreement, the guest agrees that such action constitutes a material breach. Maplewood Getaways reserves the right to: (a) pursue recovery of the disputed amount through all available legal remedies; (b) recover any chargeback administration fees, legal costs, or collection costs incurred; and (c) report the matter to applicable consumer protection or fraud authorities. Initiating a fraudulent or unfounded chargeback in respect of a legitimate charge may constitute fraud under applicable Canadian law.
2Refund Policy
Important — All cancellations must be submitted in writingCancellation requests must be sent by email to Maplewood Getaways. The date and time of written receipt by Maplewood Getaways determines the applicable refund tier. Verbal or platform-message-only cancellations are not accepted unless confirmed by Maplewood Getaways in writing.
2.1

2.2
Cleaning Fee. The one-time cleaning fee is non-refundable in all circumstances once a booking has been confirmed, regardless of cancellation timing or reason.
2.3
Early Departure. No refund will be issued for unused nights resulting from voluntary early departure by any guest, regardless of reason, including personal circumstances, dissatisfaction with the property, or events not attributable to a Maplewood Getaways breach.
2.4
Security Deposit on Cancellation. Upon a valid cancellation under Section 2.1, any pre-authorized security deposit hold will be released in full, provided no outstanding damage or fee claim exists at the time of cancellation.
2.5
Cancellation by Host. In the event Maplewood Getaways cancels a confirmed booking for any reason within its reasonable control, guests will receive a full refund of all rental amounts paid. Maplewood Getaways' liability is limited to this refund and does not extend to travel costs, alternative accommodation, or any other consequential losses.
2.6
Force Majeure. Neither party shall be in breach of this Agreement for failure to perform due to circumstances genuinely beyond their reasonable control, including acts of God, natural disasters, government-declared emergencies, mandatory travel restrictions, or utility failures. In such events, Maplewood Getaways will work in good faith regarding rescheduling, credits, or partial refunds, but no full refund is guaranteed beyond what applicable Ontario law requires.
2.7
Refund Processing. Eligible refunds will be returned to the guest's original payment method within 10 business days of cancellation confirmation. Timing of funds clearing is subject to the guest's card issuer or financial institution.
3Travel Insurance
3.1
Guest Responsibility. Maplewood Getaways strongly encourages all guests to obtain comprehensive travel insurance prior to their stay, including coverage for trip cancellation, trip interruption, medical emergencies, personal liability, and personal property loss or theft. Maplewood Getaways' cancellation policy applies regardless of the reason for cancellation, and no exceptions are made for situations that may have been covered by travel insurance.
3.2
No Host Liability. Maplewood Getaways accepts no responsibility or liability for any loss, cost, or damage suffered by a guest as a result of their failure to obtain adequate travel or liability insurance coverage. The guest's personal liability insurance does not substitute for their obligation to comply with these Policies.
4Check-In & Check-Out

4.1
Check-In. The Property will be available for guest access from 4:00 PM on the arrival date. Early check-in is not permitted unless expressly confirmed by Maplewood Getaways in writing prior to arrival, and may be subject to an additional fee.
4.2
Check-Out. Guests must fully vacate the Property and remove all personal belongings by 11:00 AM on the departure date. Late check-out without prior written approval will result in a late departure charge of 25% of the nightly rate for your booking, which may be deducted from the security deposit or invoiced separately.
4.3
Smart Lock Access. Property access is granted via a smart door lock system using either a unique PIN code or app-based access. Access credentials will be provided to the primary guest no later than 24 hours before check-in, subject to full payment being confirmed. Guests must not share access credentials with any person not registered as an occupant. Tampering with, disabling, or attempting to override the smart lock system is prohibited and will be treated as a breach of these Policies.
4.4
Departure Checklist. Before checking out, all guests must complete the following:
  • Move all garbage and recycling to the outdoor bins, separated according to the municipality's requirements (details in the Welcome Guide)
  • Leave all used wet towels in the bathrooms — do not place on beds, furniture, or floors
  • Turn off all lights, ceiling fans, and non-essential appliances throughout the Property
  • Ensure all windows and exterior doors are closed and locked
  • Ensure the hot tub cover is replaced and secured
  • Return the Property to a generally tidy condition — dishes clean and put away, garbage bagged
Failure to complete reasonable departure tasks may result in an additional cleaning charge deducted from the security deposit.
5Occupancy & Permitted Use
5.1
Occupancy Limit. Maximum permitted occupancy is determined by the total number of guests declared on your reservation at the time of booking, or as subsequently confirmed by mutual written agreement with Maplewood Getaways. The guest count stated on the confirmed booking is the binding occupancy limit for the duration of the stay.
5.2
No Unauthorized Guests. Any guests, visitors, or occupants present at the Property beyond the confirmed booking count are strictly prohibited. Discovery of unauthorized occupants at the Property will constitute a material breach of this Agreement and will void the rental licence with immediate effect. In such cases, all guests may be required to vacate the Property immediately with no refund, and the full security deposit will be forfeited without prejudice to any additional claims.
5.3
Permitted Use. The Property is made available for exclusive private recreational use only. No commercial activity, commercial filming, photography for media or advertising purposes, subletting, or any use other than private vacation accommodation is permitted without the prior written consent of Maplewood Getaways.
5.4
No Parties or Large Gatherings. Large, loud, or organized parties, events, receptions, or gatherings — whether or not guests exceed the occupancy limit — are strictly prohibited. Maplewood Getaways defines a prohibited gathering as any organized event involving amplified music, excessive noise, or a group dynamic inconsistent with private vacation use. Violation of this clause will result in immediate termination of the rental and forfeiture of all fees and the security deposit.
5.5
Responsibility for All Occupants. The primary guest named on the booking is the responsible party and accepts full personal liability for the conduct of all occupants and any visitors at the Property. All obligations in these Policies apply equally to every person present at the Property during the rental period.
5.6
Prohibited Activities. Guests shall not, and shall not permit others to: engage in any illegal activity at or from the Property; discharge fireworks, firearms, or weapons; tamper with, disable, or cover any smoke detector, carbon monoxide detector, or fire extinguisher; or engage in any activity that poses a risk of harm to persons, the Property, or neighbouring properties.
6Noise & Quiet Hours
Municipal Noise By-Laws Are Strictly EnforcedLocal noise by-laws are actively enforced by the municipality. Violations may result in fines issued directly to guests. Any costs arising from noise complaints are the guest's sole responsibility.
6.1
Quiet Hours. Strict quiet hours are in effect daily between 9:00 PM and 8:00 AM, consistent with applicable municipal noise by-laws. During these hours, all outdoor activity, amplified music, and any noise audible beyond the Property boundary must stop entirely.
6.2
Noise Standards at All Times. Outside of quiet hours, guests are still required to maintain a noise level that does not unreasonably disturb neighbouring properties. At no time is loud music, shouting, yelling, amplified sound directed outdoors, or sustained disruptive noise permitted — regardless of time of day.
6.3
Guest Liability for Noise Fines. Any fine, penalty, order, or charge issued to Maplewood Getaways by the municipality, law enforcement, or any authority as a direct result of a noise complaint attributable to the guest's conduct shall be the sole financial responsibility of the guest. Such amounts will be charged to and paid by the guest, and may be deducted from the security deposit or invoiced directly.
6.4
Escalation. Upon a substantiated noise complaint, Maplewood Getaways may issue a written warning. A second violation or failure to comply may result in immediate termination of the rental with no refund.
7Smoking Policy
Zero Tolerance — No Smoking Inside or Within 50 Feet of the PropertyAny evidence of indoor smoking will result in immediate capture of the full security deposit and additional remediation charges. There are no exceptions to this policy.
7.1
Indoor Smoking Prohibition. Smoking of any kind is strictly prohibited inside the Property and within 50 feet (approximately 15 metres) of the building at all times. This applies to all smoking or vaping devices and substances, including but not limited to cigarettes, cigars, pipes, cannabis, vaping devices and e-cigarettes, hookahs, shisha, and any other inhalable substance.
7.2
Outdoor Smoking. Smoking is permitted outdoors beyond the 50-foot boundary. Guests are responsible for the safe and complete disposal of all cigarette butts and smoking waste — all discarded materials must be fully extinguished and placed in appropriate waste receptacles. Open disposal on the ground, lawn, or near the property is prohibited and constitutes a fire hazard.
7.3
Remediation Costs. If evidence of indoor or near-building smoking is found upon inspection (including odour, staining, ash, burn marks, or residue), the guest authorizes Maplewood Getaways to capture the full security deposit. Where remediation costs exceed the deposit, the guest will be invoiced for the full cost of professional cleaning, ozone treatment, repainting, HVAC servicing, or any other required restoration work.
7.4
Cannabis. Cannabis use is subject to all applicable Ontario laws. Regardless of provincial regulations, smoking or vaping cannabis indoors or within 50 feet of the Property is prohibited on the same basis as tobacco. Guests are solely responsible for compliance with all laws governing cannabis possession and consumption.
8Pet Policy
8.1
Pets Not Permitted by Default. Pets are not permitted at the Property unless prior written approval has been granted by Maplewood Getaways at the time of booking or subsequently confirmed in writing. Bringing an undisclosed or unapproved pet to the Property constitutes a material breach of this Agreement and may result in additional charges, immediate termination, and forfeiture of the security deposit.
8.2
Pet Fee. Where pets are approved, a non-refundable pet cleaning fee per pet per stay is required. This fee covers additional post-stay cleaning associated with pet presence and does not authorize damage or entitle the guest to reduced standards of care.
8.3
Guest Obligations for Pets. The guest accepts full responsibility for the safety, behaviour, and supervision of any approved pet and shall: keep pets off all furniture, beds, and upholstered surfaces; immediately clean up all pet waste from all areas of the Property; prevent pets from entering the pool, hot tub, or dock enclosure areas; prevent pets from causing damage to landscaping, gardens, fencing, or interior surfaces; and ensure pets do not cause disturbance to neighbouring properties.
8.4
Pet Damage Liability. The guest is fully liable for all damage, staining, odour, or remediation costs caused by pets. These costs will be deducted from the security deposit. Where costs exceed the deposit, the guest is personally liable for the full difference.
8.5
Service Animals. Nothing in this Section restricts the rights of persons with disabilities with respect to certified service animals under the Accessibility for Ontarians with Disabilities Act, 2005 and applicable human rights legislation.
9Swimming Pool
Warning — Risk of Drowning, Serious Injury, or Death

Swimming pools present an inherent risk of drowning, serious injury, and death. Children face heightened risk at all times. Use of the pool is entirely at your own risk. By accessing the pool, you and all occupants voluntarily assume all associated risks.

9.1
Pool Hours. The swimming pool is available for use daily between 10:00 AM and 7:30 PM only. Pool access is not permitted outside these hours under any circumstances.
9.2
Supervision of Minors. Children under the age of 16 must be actively and continuously supervised by a responsible adult (18 years or older) at all times when in, on, or near the pool area. The supervising adult must remain poolside and attentive. This requirement is absolute and non-negotiable.
9.3
Pool Safety Rules. All pool users must comply with the following at all times:
  • No diving unless the pool is specifically designed and marked as a diving area;
  • No running on the pool deck or surrounding surfaces;
  • No glass containers or glassware of any kind within the pool enclosure;
  • No pool use while under the influence of alcohol, cannabis, or any impairing substance;
  • Non-swimmers and weak swimmers must use appropriate personal flotation devices;
  • Do not tamper with, remove, or misuse any pool safety equipment or lifesaving devices;
  • No soaps, chemicals, or foreign substances to be added to the pool water;
  • No electrical devices to be used in or near the pool water.
9.4
No Adjustment of Pool Equipment. Guests must not adjust pool pumps, chemical feeders, heating controls, filtration systems, or any pool equipment. Any malfunction or safety concern must be reported to Maplewood Getaways immediately.
9.5
Pool Damage. Any damage to the pool structure, lining, equipment, or surrounding area caused by guest misuse will be charged to and paid by the guest, and deducted from the security deposit or invoiced separately.
9.6
Assumption of Risk & Waiver. By accessing and using the swimming pool, the guest — on behalf of themselves and all occupants and their respective heirs, successors, and personal representatives — voluntarily assumes all risks of personal injury, drowning, property damage, or death arising from pool use, whether caused by negligence, equipment failure, weather, or any other cause, and releases, waives, and discharges Maplewood Getaways, its owners, agents, and representatives from all related claims, demands, and liabilities to the fullest extent permitted by Ontario law.
9.7
Indemnification. The guest shall indemnify and hold harmless Maplewood Getaways from any and all third-party claims, losses, legal fees, and costs arising from any injury or death occurring in or around the pool during the guest's rental period.
10Hot Tub
Warning — Health Risks Associated with Hot Tub Use

Hot tub use carries risks including drowning, hyperthermia, bacterial and fungal infection, and cardiovascular complications. Pregnant individuals and persons with heart conditions, high blood pressure, or circulatory disorders should not use the hot tub. When in doubt, consult a physician before use.

10.1
Hot Tub Hours. The hot tub is available for use 24 hours a day, subject always to the quiet hours provisions in Section 6. Outdoor use of the hot tub during quiet hours must be conducted quietly and must not disturb neighbouring properties.
10.2
Supervision of Minors. Children under the age of 18 are not permitted in the hot tub under any circumstances. All other minors must be supervised by a responsible adult (18+) at all times.
10.3
Hot Tub Safety Rules. All users must comply with the following:
  • Limit continuous soaking to a maximum of 15 minutes; exit, cool down, and rehydrate before re-entering;
  • Never use the hot tub while under the influence of alcohol, cannabis, or any impairing substance;
  • No glass containers or glassware in or near the hot tub at any time;
  • Do not submerge your head or face in the water;
  • Never use the hot tub alone — at least one other person must be present at all times;
  • Shower before entering the hot tub;
  • Do not add soaps, bath products, essential oils, bath bombs, or any unapproved substance to the water;
  • Do not adjust the temperature controls, jets, or chemical systems without Maplewood Getaways' authorization;
  • Replace and secure the hot tub cover after every use;
  • No electrical devices to be used in or near the hot tub water.
10.4
No Adjustment of Hot Tub Equipment. Guests must not adjust hot tub pumps, heaters, filters, chemical dispensers, or control systems. Any malfunction or water quality concern must be reported to Maplewood Getaways immediately.
10.5
Hot Tub Damage & Contamination. Damage to the hot tub shell, cover, jets, plumbing, filters, or control systems caused by guest misuse will be charged to the guest. Introduction of soaps, oils, or foreign substances requiring a full drain, system flush, and chemical reset will incur a minimum service fee of $500 CAD, in addition to any repair costs.
10.6
Assumption of Risk & Waiver. By accessing and using the hot tub, the guest — on behalf of themselves and all occupants and their respective heirs and representatives — voluntarily assumes all risks of personal injury, illness, infection, hyperthermia, or death arising from hot tub use, whether caused by negligence, equipment failure, water chemistry, or any other cause, and releases, waives, and discharges Maplewood Getaways, its owners, agents, and representatives from all related claims and liabilities to the fullest extent permitted by Ontario law.
10.7
Indemnification. The guest shall indemnify and hold harmless Maplewood Getaways from any and all third-party claims, losses, and legal costs arising from any injury, illness, or death occurring in or around the hot tub during the guest's rental period.
11Waterfront & Water Access
Warning — Waterfront Access at Own Risk

Waterfront and open-water access is inherently dangerous and unpredictable. Natural water bodies present risks including drowning, currents, submerged hazards, weather changes, and cold water shock. Maplewood Getaways is not responsible for the safety of guests who choose to access waterfront areas. All waterfront use is entirely at the guest's own risk and discretion.

11.1
Voluntary Access. Any guest who accesses the waterfront, dock, shoreline, lake, river, or other natural water feature associated with the Property does so entirely of their own free will and at their sole risk. Maplewood Getaways makes no representation or warranty as to the safety, depth, current, clarity, or condition of any natural body of water.
11.2
Safety Rules. All guests accessing waterfront areas should: always swim with a companion; wear personal flotation devices when on the dock or on watercraft; supervise children at all times near water; avoid waterfront access at night or in adverse weather; be aware of changing water and weather conditions; and never swim under the influence of alcohol or impairing substances.
11.3
Dock & Watercraft Use.All applicable Transport Canada and Ontario boating safety regulations apply at all times.
11.4
No Host Responsibility. Maplewood Getaways does not provide lifeguarding, waterfront supervision, or any safety services at the waterfront. The host is not responsible for any accident, injury, drowning, or death occurring in, on, or near any natural water body, dock, or shoreline area associated with the Property.
11.5
Assumption of Risk & Waiver. By accessing any waterfront area, dock, or natural water body at or near the Property, the guest — on behalf of themselves and all occupants and their respective heirs and representatives — voluntarily assumes all risks of personal injury, drowning, property damage, or death, whether arising from negligence, natural conditions, or any other cause, and releases, waives, and discharges Maplewood Getaways, its owners, agents, and representatives from all related claims and liabilities to the fullest extent permitted by Ontario law.
11.6
Indemnification. The guest shall indemnify and hold harmless Maplewood Getaways from any and all third-party claims, losses, and legal costs arising from any waterfront-related injury, incident, or death occurring during the guest's rental period.
12Property Care & Damage
12.1
Standard of Care. Guests are expected to treat the Property, its furnishings, fixtures, appliances, and all contents with the same care they would apply to their own home. The Property must be left in a reasonably clean and undamaged condition, consistent with normal use.
12.2
Reporting Damage. Guests must notify Maplewood Getaways as soon as reasonably possible upon discovering any pre-existing damage, safety hazard, or new damage occurring during their stay. Timely reporting is important — failure to report damage before check-out may result in the guest being held fully responsible upon inspection.
12.3
Prohibited Actions. Guests must not: rearrange or remove major furniture or appliances; make alterations, nail holes, or adhere anything to walls, ceilings, or floors; paint, modify, or alter any fixture, fitting, or surface; operate appliances contrary to provided instructions or the Welcome Guide; or use any outdoor fire pit, BBQ, or fuel appliance without first reviewing the applicable safety instructions.
12.4
Damage Charges. All damages beyond normal wear and tear will be assessed upon check-out inspection. The guest authorizes Maplewood Getaways to capture the applicable amount from the security deposit and, where costs exceed the deposit, to invoice the guest for the full outstanding balance. Costs are based on actual repair or replacement invoices, contractor estimates, or fair market value as applicable.
12.5
Lost or Forgotten Items. Maplewood Getaways will make reasonable efforts to secure items left behind for up to 14 days following check-out. After this period, unclaimed items may be donated or disposed of. Return shipping is at the guest's expense. Maplewood Getaways accepts no liability for lost or forgotten belongings.
13Limitation of Liability & Indemnification
13.1
Limitation of Host Liability. To the fullest extent permitted by Ontario law, Maplewood Getaways shall not be liable to the guest or any occupant for: (a) personal injury, illness, or death arising from use of the Property or any amenity; (b) loss, theft, or damage to the guest's personal property; (c) service interruptions including power, water, internet, or appliance failures beyond Maplewood Getaways' reasonable control; or (d) acts or omissions of third parties, including utility providers, neighbouring properties, or emergency services.
13.2
Guest Indemnification. The guest agrees to indemnify, defend, and hold harmless Maplewood Getaways, its owners, agents, and representatives from and against any and all claims, damages, losses, fines, legal costs, and expenses arising from: (a) any breach of these Policies by the guest or any occupant; (b) any negligent, reckless, or unlawful conduct by the guest, occupant, or visitor; or (c) any third-party claim arising from the guest's use or occupation of the Property.
13.3
Maximum Liability. Where any liability of Maplewood Getaways is found to exist notwithstanding the foregoing, total liability shall not exceed the total rental amount actually paid by the guest for the relevant booking.
14General House Rules
14.1
Parking. A maximum of 4 vehicles are permitted on the Property at any time, unless a higher number is expressly agreed upon in writing by Maplewood Getaways prior to arrival. All vehicles must be parked in designated areas only. Parking on lawns, gardens, fire lanes, or neighbouring properties is strictly prohibited.
14.2
Utility Use. Guests are expected to use all utilities — including electricity, water, and heating or cooling systems — responsibly and in a manner consistent with normal residential use for the declared occupancy. This includes: turning off lights and appliances when not in use; not leaving doors or windows open while HVAC systems are running; and not running dishwashers, laundry, or water systems unnecessarily or in excess. Maplewood Getaways reserves the right to charge for materially excessive utility consumption where it significantly exceeds reasonable baseline usage, at cost.
14.3
Fuel Safety & Usage. Where the Property includes a propane BBQ, gas fireplace, fire pit, or any other fuel-powered appliance or feature, guests must read and follow all safety and operating instructions provided in the Welcome Guide before use. Guests must: never leave a lit flame or burning appliance unattended; fully extinguish all fires and shut off all fuel valves after each use; not attempt to fill, connect, or modify propane tanks or gas lines; and report any gas odour, leak, or malfunction to Maplewood Getaways immediately and vacate the area. Improper use of fuel appliances is a safety hazard and may void the guest's security deposit.
14.4
Internet Use. Wi-Fi internet access is provided as a convenience and Maplewood Getaways makes no warranty as to speed, reliability, or availability. Guests must not use the Property's internet connection for any unlawful activity, including unauthorized downloading, streaming, or distribution of copyrighted material, or any activity that may expose Maplewood Getaways to legal or regulatory liability.
14.5
Welcome Guide. A detailed Property Welcome Guide will be provided before check-in, covering appliance instructions, garbage and recycling procedures, emergency contacts, local information, and property-specific rules. Guests are expected to read and follow the Welcome Guide. Its contents form part of this Agreement.
15Termination & Removal
15.1
Right to Terminate. Maplewood Getaways reserves the right to immediately terminate the rental licence and require all guests and occupants to vacate the Property, with no refund of any amounts paid, if a guest: (a) breaches any material term of these Policies and fails to remedy the breach within one (1) hour of notice; (b) causes or threatens harm to any person or property; (c) engages in or permits illegal activity; (d) exceeds the permitted occupancy; (e) hosts an unauthorized gathering or event; (f) commits repeated or serious noise violations; or (g) engages in conduct that, in Maplewood Getaways' reasonable judgment, poses an unacceptable risk to the Property, neighbours, or the safety of any person.
15.2
Vacation of Property. Upon termination, all guests and occupants must immediately vacate the Property and remove their belongings. Maplewood Getaways may request the assistance of local law enforcement to facilitate vacation of the Property if guests do not comply.
15.3
No Tenancy Rights. This Agreement grants a personal licence to occupy only and does not create any tenancy, leasehold, or possessory interest protected under the Residential Tenancies Act, 2006 (Ontario) or any other legislation. Guests have no right to contest removal under residential tenancy law.
16Privacy & Security Monitoring
16.1
Personal Information. Maplewood Getaways collects personal information from guests solely for the purposes of administering your rental, verifying identity, processing payments, and complying with applicable law. This information will not be sold or disclosed to third parties except as required by law, platform terms, or in connection with a legitimate insurance or legal claim.
16.2
Exterior CCTV Cameras. The Property has CCTV security cameras positioned to monitor the exterior of the Property only — including entry points, driveway, and outdoor areas. No cameras are located inside the Property or in any interior living space. By confirming your booking, you acknowledge and consent to exterior security monitoring as a condition of your stay.
16.3
No Interior Recording. There are no audio or video recording devices of any kind in any interior room of the Property. If a guest discovers any suspected interior surveillance device, they should report it immediately to local police and the booking platform.
16.4
Indoor Noise Decibel Monitor. A noise-level monitoring device (decibel meter) is installed in common interior areas of the Property. This device measures ambient sound levels only — it does not record or transmit audio conversations. It is used solely to help ensure compliance with noise policies and the comfort of neighbouring properties. By confirming your booking, you acknowledge and consent to this monitoring.
17General Legal Provisions
17.1
Governing Law. These Policies and the Short-Term Rental Agreement are governed exclusively by the laws of the Province of Ontario and applicable federal laws of Canada. Both parties irrevocably attorn to the exclusive jurisdiction of the courts of Ontario for resolution of any dispute.
17.2
Dispute Resolution. The parties agree to first attempt to resolve any dispute through good-faith written communication. If unresolved within 30 days of written notice, either party may pursue their rights through Ontario Small Claims Court (for claims up to $35,000 CAD) or the Superior Court of Justice as appropriate.
17.3
Entire Agreement. These Policies, together with the Lodgify booking confirmation, any written addenda, and the Property Welcome Guide, constitute the entire agreement between the parties and supersede all prior representations, communications, and understandings, whether written or verbal.
17.4
Severability. If any provision of these Policies is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
17.5
No Waiver. Maplewood Getaways' failure to enforce any provision on a given occasion does not waive the right to enforce it on any future occasion.
17.6
Amendments. No amendment or modification of these Policies shall be effective unless made in writing and confirmed by Maplewood Getaways.
17.7
Electronic Acceptance. Completing a booking through Lodgify or any associated platform constitutes electronic acceptance of these Policies with the same legal force as a written signature, pursuant to the Electronic Commerce Act, 2000 (Ontario).
17.8
Language. The parties have requested that these Policies and all related documents be in the English language. Les parties ont demandé que ces politiques et tous les documents connexes soient rédigés en langue anglaise.
18Guest Acknowledgement
By completing your booking with Maplewood Getaways, you confirm and agree to the following:
  • You are at least 18 years of age and have full legal capacity to enter into this Agreement;
  • You have read these Policies in their entirety and understand all terms and conditions;
  • You agree to be legally bound by all Policies on behalf of yourself and all occupants;
  • You have the authority to bind all other guests, occupants, and visitors to these terms, and you accept personal responsibility for their compliance;
  • All information provided at the time of booking is accurate and complete;
  • You acknowledge the inherent risks associated with use of the pool, hot tub, and waterfront and accept those risks voluntarily;
  • You understand that this Agreement creates a licence to occupy only and does not confer any tenancy rights under Ontario law;
  • You consent to exterior CCTV monitoring and the use of an indoor decibel noise meter in common areas as described in Section 16.
